Philosophy of sport orthodoxy maintains the following three theses: (1) all sports (or all refereed sports) are games; (2) games are as Suits defined them; and (3) sprints are sports. The title is meant to indicate that consciousness is being examined largely within the history of philosophy, and within the period of time from Descartes to Ayer. Investigators aiming to understand consciousness and minds usually try to take account of all individual human minds, so as to have the most data for the most encompassing induction. The problem with that approach is that because of the vastness of the data, its results tend to be vague, lacking the specificity of studies (...) of individuals. On the other hand, the problem with studies of individuals is that they cannot guarantee generality, as the opposing method can. This book's distinctive approach aims at a middle way, getting the best of the two opposing methods by drawing its data from the history of philosophy, especially the history of the great philosophers. Philosophers of criminal punishment widely agree that criminal punishment should be “proportional” to the “seriousness” of the offense. But this apparent consensus is only superficial, masking significant dissensus below the surface. Proposed proportionality principles differ on several distinct dimensions, including: regarding which offense or offender properties determine offense “seriousness” and thus constitute a proportionality relatum; regarding whether punishment is objectionably disproportionate only when excessively severe, or also when excessively lenient; and regarding whether the principle can deliver absolute judgments, or only (...) comparative ones. This essay proposes that these differences cannot be successfully adjudicated, and one candidate proportionality principle preferred over its rivals, in the abstract; a proportionality principle only makes sense as an integrated part of a more complete justificatory theory of criminal punishment. It then sketches a proportionality principle that best fits the responsibility-constrained pluralist theories of criminal punishment that currently predominate. The proportionality principle it favors provides that punishments should not be disproportionately severe, in noncomparative terms, relative to an agent’s culpability in relation to their wrongdoing. Organizational institutionalism has shown how institutional entrepreneurs can introduce new logics into fields and push for their broader acceptance. In academic science in the United States, however, market logic gained strength without such an entrepreneurial project. This article proposes an alternative “practice selection” model to explain how a new institutional logic can gain strength when local innovations interact with changes outside the field. Actors within a field are always experimenting with practices grounded in a variety of logics. When one logic (...) is dominant, innovations based on alternative logics may have trouble gaining the resources they need to become more broadly institutionalized. But if a changing environment starts systematically to favor practices based on an alternative logic, that logic can become stronger even in the absence of a coherent project to promote it. This is what happened in US academic science, as growing political concern with the economic impact of innovation changed the field’s environment in ways that encouraged the spread of local market-logic practices. A Platonic explanation of non-modal and modal truths is explained and defended using non-spatiotemporal entities as their truthmakers. It is argued, further, that this theory is parsimonious, naturalistic, and ontologically serious. These features should commend the view to a wide swath of philosophers.

This paper examines moral misconduct and recidivism at the corporate level. We analyze the factors that facilitate moral transgressions and why some companies appear to be serial offenders. We propose that negative learning is a core process that encourages repeat misconduct. We offer a framework of negative learning, grounded in a case example. The framework also suggests circumstances that reverse the vicious selfreinforcing cycle of negative learning, so companies learn to adopt a more ethical stance when faced with moral choices.

In the eighteenth century, the economic problem was reformulated according to a particular set of politico-economic components, in which the pursuit of individual freedom was elevated to an ethical and political ideal. Subsequent developments of this individualist philosophy together with the achievements of technological progress now appear as a threat to future existence. Extensive environmentaldegradation and persistent global inequalities of wealth demand a new reformulation of the economic problem. Sustainable development has emerged as the most recent economic strategy for addressing (...) concerns about ecological integrity and social justice. Although there is a recognized continuum of understanding about the concept—from conservative to radical—it has been argued that only the radical version of sustainable development embodies the ethical capacity to address these concerns. Simultaneously the perennial existential question “How should we live?” has been raised anew along with the novel ethico-moral question: “How should we arrange our systems of production and consumption to ensure the sustainability of the Earth under conditions of conspicuous and pressing environmentallylimiting conditions?” Moreover, the strong normative dimension embodied in the radical version of sustainability represents a challenge to liberal democracy and its understanding of individual and collective goods. I argue that the radical approach has the capacity to relieve what is an inherently acute tension of modern life and to reconcile individual autonomy with the wider social and ecological good. One of the most fundamental questions in general jurisprudence concerns what makes it the case that the law has the content that it does. It is the job of theories of legal content to provide answers. This article offers a novel positivist theory of legal content. According to the theory it calls “principled positivism,” legal practices ground legal principles, and legal principles determine legal rules. This two-level account of the determination of legal content differs from Hart’s celebrated theory in two (...) essential respects: in relaxing Hart’s requirement that fundamental legal notions depend on judicial consensus; and in assigning weighted contributory legal norms—“principles”—an essential role in the determination of legal rights, duties, powers, and permissions. Drawing on concrete examples from American statutory and constitutional law, the article shows how the version of positivism that it introduces and defends betters Hart’s in meeting the most formidable challenges to positivism that Dworkin marshaled. The article also explains why the revisions it advances matter, legally as well as philosophically. (shrink)

What is the best way to respond to monuments in our communities if they represent people who stood for harmful ideas and/or societal structures? I start with the assumption that it would be best for everyone if all of the harmful monuments were removed from our public squares. The more interesting question is: Why would it be best? I will examine critically two different explanations as to why it would be best: one, Plato's, which rests on the harmful non-intellectual influences (...) of images and the other, Socrates’, which rests on the harmful intellectual influences of those images. In the end, I shall argue that Socrates got it right and Plato wrong due to the former's ability to explain human behaviour and the latter's surprising lack of that same ability, despite how widely it is believed. If the argument is correct, it will have deep and widespread implications for how we educate our children and ourselves about every important aspect of the human condition. (shrink)

Since 1999 Thoemmes Press (now Thoemmes Continuum) has been engaged in a large-scale programme of biographical dictionaries of philosophy and related subjects. This volume on Irish philosophers follows the standard format of arranging entires alphabetically by thinker.
